Un-Filed Return Defenses
While there are many reasons why a taxpayer may not file a tax return,
you need to be aware of the following:
-
Failure to file tax returns may be construed as a criminal
act by the IRS.
-
This type of criminal act is punishable by one year in jail for each
year not filed.
-
Needless to say, it's one thing to owe the IRS money, but another thing
to potentially lose your freedom for failure to file a tax return.
-
The IRS may file a “Substitute for Return” (SFR) tax return
for you. Because SFR returns are filed in the best interest of the
government, the only deductions you'll see are
standard deductions and one personal exemption.
-
You will not get credit for deductions which you may be entitled to such
as exemptions for spouses, children, interest and taxes on your home, cost
of any stock or real estate sales, and business expenses, etc.
Regardless of what you have heard, you have the right to file your original
tax return, no matter how late it's filed.
Whether they are personal, payroll or corporate tax returns,
Galante Tax Group can get you current in filing, so you can
pursue tax relief. We
provide the services of an experienced CPA to complete your tax returns,
and then we aggressively defend those tax returns before the IRS.

Wage Garnishment Removal
Wage garnishment occurs when a creditor like the IRS has obtained a judgment
on a debt (IRS back taxes or other debt), and they obtain a full or partial
payment by seizure of a portion of your assets such as wages, or bank accounts. When
the IRS garnishes your pay, your employer must by law send a large part of
your paycheck directly to the IRS. This tactic may leave you with very
little to live on, and can make your life miserable.
Galante Tax Group will assist you in getting back your entire
paycheck. We
focus on resolving your IRS problem. Our goal is to negotiate a settlement
and have the IRS remove their wage garnishment.
Depending upon your individual circumstances, Galante Tax
Group will either file an Offer in Compromise to permanently settle your
tax debt, or negotiate a monthly payment arrangement you can live with.

Lien & Levy Removal
A Federal tax lien is an administrative action by the IRS to seize property
to satisfy a tax liability. A Federal tax levy is the actual seizure
of that property. An IRS lien or levy placed on your property, or bank
account, can be financially and emotionally devastating for
a small business owner or family.
If you take no action, the bank is required by law to freeze
your assets and give control to the IRS. When that happens, you could find
yourself unable to make your mortgage payments or pay your utilities and
other bills, making a bad problem worse.
If you receive a lien or levy notice, immediately contact
Galante Tax Group, and we will take action to protect you.

IRS Penalty Elimination
Failure to pay IRS back taxes can result in penalties and
interest that can compound over years, creating tax debt that could be substantially
larger than the initial amount owed. Non-payment of penalties and interest
can result in garnishment of your wages, placement of a levy or lien against
your property, seizure of your assets, or even more serious penalties.
The
longer you wait, the greater the risk of IRS problems mounting
against you. Galante
Tax Group can now help you stop the cycle of penalties by
using our veteran ex-IRS Tax Team to negotiate an abatement
of penalties.
Galante Tax Group has helped others get their IRS penalties
removed or reduced based upon a reasonable cause argument. Call
us today to discuss your individual situation, and see how
we can get your penalties removed or reduced.

Payroll Tax Problems
The IRS is very aggressive in their collection attempts for past due payroll
taxes. The penalties assessed on delinquent payroll tax deposits or
filings can dramatically increase the total amount owing in a matter of months.
Not only is your business at risk, but you may be personally
liable, as well. Once
the IRS has determined the business cannot pay its past due payroll taxes, they
turn their sights on the individuals who the IRS says are responsible and willful
for not paying the payroll taxes.
Galante Tax Group has helped business owners. We know how to protect you
and your business. The veteran ex-IRS Tax Team at Galante Tax Group can
custom design a game plan for your repayment of taxes and negotiate with the
IRS to avoid bank levies and asset seizure, if you meet the qualifying criteria.

Offers in Compromise
An offer in compromise is an agreement between the taxpayer and IRS that
resolves the taxpayer's debt. By accepting less than full payment under
certain circumstances, the IRS has the authority to settle, or "compromise," federal
tax liabilities.
Depending upon your financial situation, Galante Tax Group
will negotiate with the IRS to settle your tax debt for much less than the
amount you currently owe. Our
veteran ex-IRS Tax Team is ready to help you prepare and submit an Offer in Compromise
to solve to get rid of your IRS tax problem.

Installment Agreements
If your available cash is more than the tax liability, you will normally
be required to pay immediately. But if you can prove inability to pay,
the IRS will consider a monthly payment arrangement (Installment
Agreement), and allow you to pay your liabilities over time.
Whether the IRS is demanding full payment up-front or a payment
plan that is substantially higher than what you can afford
to pay, our veteran ex-IRS Tax Team can negotiate to set up an arrangement
for the lowest possible monthly payment and also provide you with various
options for making those payments, including the Electronic Federal Tax
Payment System, direct debit, payroll deduction, credit card, and payment
by check or money order. Since
the government will not agree to an installment agreement until all necessary
tax returns are filed, we can also have a CPA prepare all of your returns
to bring you into compliance before arranging a payment plan.
If you cannot afford to make monthly payments and do not qualify for another
type of tax relief, such as an offer in compromise, we will negotiate to
have your account placed in a "currently not collectible" status. By
doing so, you will not be required to make any payments and the IRS will
not pursue collection action.

Innocent Spouse Defenses
Taxpayers often find themselves in trouble with the IRS
because of their spouses or ex-spouse's actions. The IRS understands
that these situations do occur.
In order to help taxpayers that are being subjected to IRS
problems because of their spouse's actions, the IRS has come
up with guidelines for innocent spouse tax relief where a person may not
be subject to the taxes caused by their spouse or ex-spouses. Galante Tax Group has successfully
gained innocent spouse relief for others, and can help you as well.

Audit & Appeals Representation
Audit
Your tax return may be examined (audited) for a variety of reasons. For
instance, your return may be selected for audit based upon computer scoring
because items on your return don’t fit the norm. Or your return
may be selected for audit on the basis of information received from a third
party (W-2 or Form 1099). In addition, your return may be selected
for audit based as a result of information received from other sources on
your potential noncompliance with the tax laws or inaccurate filing.
An audit can be in the form of a face-to-face examination
by an IRS Revenue Agent or Tax Auditor, or in the form of letters asking
for explanations of items on a tax return or supporting documentation.
No matter how simple the IRS’ request for information may be, we never
advise any taxpayer to represent themselves in an IRS audit. Even if
you have been absolutely honest and filed everything correctly, meeting with
the IRS can be an intimidating experience. The IRS auditor represents
the IRS, and is looking to find errors on your return. Shouldn’t
you have someone on your side to ensure that the IRS doesn’t take advantage
of you?
We highly recommend that you hire a tax professional to represent
you before the IRS. When you hire our veteran ex-IRS Tax Team, you
can be comforted by knowing that our many years of inside-the-IRS experience
will be used to protect you. You can face an audit with confidence
when the Galante Tax Group is on your side.
Appeals
If you don’t agree with a Revenue Agent or Revenue Officer’s
decision on your case, you may have the right to request an IRS administrative
hearing to review the IRS’ preliminary decision. The IRS Appeals
Office is independent of any other IRS office and provides a venue where
disagreements concerning the application of tax law can be resolved on a
fair and impartial basis for both the taxpayer and the government.
An Appeals or Settlement Officer will review the strengths
and weaknesses of the issues in your case, give them a fresh
look, and make a fair and impartial decision. Appeals conferences are conducted in
an informal manner by correspondence, telephone or in-person. Most
differences are settled in these appeals without expensive and time-consuming
court trials.
The Tax Team at Galante Tax Group has many years of inside-the-IRS
Appeals experience. We use that experience to work with Appeals
to resolve your tax dispute and get rid of your IRS problem.
